Erik recognizes that his clients' legal needs are particular to a given set of circumstances and different approaches are necessary for each individual goal. Perhaps those changes to the contract can be compromised for betterment of the business relationship down the road. Sticking to a trial strategy and seeing the case through verdict may also prove beneficial to certain clients. In addition, Mr. McLain regularly represents these business or individuals in matters involving trademark and intellectual property issues such as trademark registration; trademark and copyright litigation; right to publicity issues, and licensing transactions. Mr. McLain also represents individuals and businesses in matters involving employment law and litigation.
Mr. McLain regularly tries cases before juries and judges in both State and Federal Courts. His friendly personality and down to earth attitude present well before a jury. In fact, he often remains in contact with jurors following the completion of trial. Mr. McLain has also represented clients in several mediations/arbitrations throughout his 12 years of practice which has included matters before J.A.M.S (Judicial Arbitration and Mediation Services); AAA (American Arbitration Association); and FINRA.
Erik grew up working part-time as a commercial fisherman and still enjoys deep sea fishing in Southern California and the Long Island Sound. In his free time, he also enjoys sporting events, particularly St. John's basketball games at the Garden and NY Mets games.
