Erik McLain is the Managing Attorney and Founder of McLain Law Firm. His practice focuses on business law and litigation; trademarks and intellectual property, as well as employment matters. He practices in California and New York State Courts, as well as several Federal Courts.

Mr. McLain focuses his representation on one primary goal: QUALITY CUSTOMER SERVICE.

How does Customer Service translate in the legal services arena? Erik recognizes that his clients' legal needs are particular to a given set of circumstances and different approaches are necessary for each individual goal. Creative solutions or strategies are tailored to the client's desired outcome. For example, sometimes settlement makes sense based upon the costs and heartache associated with a matter. Perhaps those changes to the contract can be compromised for betterment of the business relationship down the road. Sticking to a trial strategy and seeing the case through verdict may also prove beneficial to certain clients. Bottom line: Mr. McLain approaches every situation with a practical perspective towards achieving the clients' goals and objectives.

Mr. McLain prides himself in providing Quality Customer Service not only through quality legal representation but also effective day-to-day communication. Phone calls are regularly returned, emails are responded to promptly, questions and options are answered and explained. Meetings are flexible based upon time, location, and client convenience. Client suggestions are thoughtfully considered and input is welcomed. Timely performance of specific tasks are achieved and communicated to the client. Mr. McLain recognizes that lawyers often obtain a bad reputation from clients simply because they do not pay enough attention.


Mr. McLain focuses his representation on various businesses and individuals involved in business transactions, business disputes, and business formation. In addition, Mr. McLain regularly represents these business or individuals in matters involving trademark and intellectual property issues such as trademark registration; trademark and copyright litigation; right to publicity issues, and licensing transactions. Mr. McLain also represents individuals and businesses in matters involving employment law and litigation.

Mr. McLain regularly tries cases before juries and judges in both State and Federal Courts. His friendly personality and down to earth attitude present well before a jury. In fact, he often remains in contact with jurors following the completion of trial. Mr. McLain has also represented clients in several mediations/arbitrations throughout his 12 years of practice which has included matters before J.A.M.S (Judicial Arbitration and Mediation Services); AAA (American Arbitration Association); and FINRA.

Erik grew up working part-time as a commercial fisherman and still enjoys deep sea fishing in Southern California and the Long Island Sound. In his free time, he also enjoys sporting events, particularly St. John's basketball games at the Garden and NY Mets games.
